Legal Expenses

Aurora Underwriting Agency has introduced legal expense insurance to provide legal services to investigate and promote the civil claim of people who would otherwise be unable to access civil justice.  Persons need only to simply click on a link on our website, outline the issue and click submit.  A considered legal commentary will be forwarded within three working days.  This service is in respect of any, conceivable legal issue.  A very valuable additional benefit offered is that the costs of pursuing or defending certain matters are insured. This benefit extends to the member’s spouse / partner and dependent children of the member under 18 years old.

Members of trade unions, affinity groups, associations, football clubs or any class of individuals who seek access to urgent legal help and guidance.

Covers Available

Personal Injury
Most matters are pursued using a “no win, no fee” agreement with a solicitor.  In the event such a matter is lost; costs against the member will be covered. In the event such a matter is successful, the member may not recover all costs involved; these costs will be covered. In the event the matter is settled before trial, and an amount is agreed “inclusive of costs”, it is usually the case that the insurance will pay the member’s solicitor’s costs in addition to this settlement amount.
Employment
This cover allows members to initiate complaints concerning unfair dismissal, unlawful termination, constructive dismissal, bullying or harassment, unjust variation or indeed any matter which is serious enough to justify legal proceedings. Cover is also for bringing action to defend a civil claim in relation to employment brought against the member by a fellow employee.
Motor Vehicle
10% of Australian motorists are uninsured. Many more only have the minimum third party cover. When two such parties have an accident, it is up to the “not at fault” party to pursue the other for all incurred costs. Such legal costs are covered, as are certain costs incurred where a member is prosecuted for an offence.
Consumer
Cover is for action to pursue a civil claim resulting from a breach of contract for goods or services bought for private use. Cover is also for action to defend a matter as a result of a dispute concerning a contract for the sale of private goods.
Home
Cover is for the costs of bringing action to pursue a claim resulting from an incident which causes actual or imminent damage to the member’s home or a nuisance or a trespass which affects, or will affect a member owning or living in their home.
Tax
Cover is for those expenses incurred arising from an audit by the Australian Tax Office or State or Territory Revenue Office concerning a member’s liability to pay tax.
